Hi there,
This is exactly what my company's attorney had told me. If the new location is within commuting distance/same metropilitan area there is no need for a LCA amendment .
If anybody thinks otherwise please feel free to correct me.
I had the same situation a few years back (Menlo Park to Fremont, CA) if you know the area. The attorney said no need for new LCA.

I am not sure what you mean by 3D designers think they have specialty skills?!
First off you don't have to be a designer to model objects that already exist in real life. You just need to know how to use a 3D Modelling program.
And second - yes - it is a skill to be able to use those programs and even more so if you are actually creating an original design.
And dont go to the "viewpoint" D'espano" or other sites for models they are extremely expensive as you say.
As a side note - depending on a model needed by someone you can ask what you need and alot of times people will create it for you for nothing ;) or have it in stock!

My GC finally recently got approved and have following questions:
• If I don’t work for my current employer for at least six months after the approval, what kind of issues comes up when applying for citizenship later. What is the law.
• Do we have to submit six months paystubs or yearly W2s.
All I am just trying to get a knowledge on this.

The Senators are coming, the Senators are coming! That's right, the Senate is debating the DHS Appropriations bill right now, and immigration amendments are being offered. I blogged about the Sessions E-Verify proposal yesterday. Well bill, that passed by voice vote this morning, but not before the Senate voted down a proposal from Senator Schumer to table the Sessions proposal. Senator Leahy, in an astute move prior to the vote on Sessions' E-Verify bill, amended that bill to include a permanent extension of the EB-5 Regional Pilot Program. So, Leahy's amendment permanently extending the EB-5 Regional Pilot Program was approved too!
Senator DeMint from South Carolina threw in a bill to mandate the construction of actual fences along 700 miles of the Southern Border, taking away the right of DHS/CBP to decide how best to protect that border. That has also passed.
Senator Hatch has now introduced a bill which includes positive changes including undoing the Widow Penalty, and a religious worker extension and a rural doctors program extension. You can still call the Senate Switchboard to voice your support for this latter bill, and your disgust with the Senate passage of laws without debate that will affect millions of lives and cost billions of dollars. You can reach your Senator by calling 202-224-3121.
All of these amendments, of course, must now go back to a conference committee with the House, and there is no guarantee that any of them will become law. But, lest you thought your time to relax from calling your Congressman was over, it has now started again. I am new to this forum. Just registered myself. I hv a question if u guys can help. I got an RFE for I485 for employment verification. Lawyer says he sent the employer verification letter with his signature instead of employers bec employer has given him authorization to do so. can anyone do like this. does this pose a problem for my I485 approval. Please help.

My EAD expired in late April
Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).
I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.
If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?
How do employers handle something like this?

Hi
I came to the US on H4 and then applied for H1-B. My H4 visa expired. My H1-B was approved but I was not staffed and hence not paid for the past one year and as a result I do not have pay stubs. I do not have the H1-B stamping on my passport. Now I want to apply for H4 from my home country based on my husband's H1-B.
My question is when I fill in the DS156 form what should I fill in for the following parts
1. #20 and #21 - Name and address of you current employer and Present Occupation
(Would I have to give details about the employer who filed my H1-B even though I do not have H1-B stamp on my passport)
2. #30 Have you ever been issued a US Visa - Yes/No (I do not have the H1-B stamp, I only have the previous H4 stamp)
When , Where, What Type of Visa (Would I have to mention about my H1 or H4?)
Please can anyone help me with these questions

It was a mistake by the guy who stamped I-94 (at CBP).
Her H-4 must be expire on your expiration date.
You need to go to nearest CBP office to get it corrected.
She need deferred inspection to get it straight. USCIS will not do it.
OR Do nothing about it and file H-4 extension along with your H1B extension.
If you do not extend her with your petition, even if she have valid I-94, she may end up in trouble later.

Were your collegues EB-2 classification with old PDs from the DoL's backlog centres?
I see some of the EB-2 indian nationals with old PDs received approvals so that USCIS can process their I-485.
If you are EB-3 then you might want to wait until Dec 2007.

I applied for the visa lottery while my EB3 I-485 was pending and while waiting for the priority date to be current. I won the lottery and got my green card and the two are COMPLETELY UNRELATED. Good luck with the visa lottery, for me, it saved my sanity!

My AP was approved Nov 16. Email from USCIS said approval notice sent. I had to travel Dec 4th. When my lawyer contacted USCIS on Nov 25th, USCIS said they were in the process of printing the form. My lawyer suggested trying for the emergency AP. The Baltimore office says walk-ins not allowed. My travel was postponed for other reasons. Double check that USCIS actually mailed the notices to you.
