My PD is July 2004 EB2 with RD 02 July 2007, ND 09 Aug 2009. NC cleared in Oct 2007, Biometrics renewed by USCIS Feb 2009 and all primary and dependent cases PreAdjudicated on 13th Apr 2009.
While doing routine status check this month by opening SR's I came to know that USCIS has screwed up my EB category on my pending I-485 application in NSC. Looks like the data entry was screwed by the USCIS contractors or mail room personell. Also the PreAdj process also completely overlooked this mistake and preadjudicated my case. Because of their mistake my case was not even considered for approvals this month and also last years when the dates were current.
I created multiple SR's and did 3 infopass appointments to find out what is the current EB Classification and finally was able to confirm through infopass appointment that USCIS has put me and my family in EB3 category (GC category E36, E37, E38) instead of EB2 (E21).
SR response were vague and did not help much. Infopass appointments were of very little help as IO's in Dallas Infopass center are not trained to handle EB - I485 related issues. They don't have access to enough information to help us. They don't know how to use their own system to find information. Tried POJ method to reach IO but always got connected to useless CSR's.
I have only one I-140 in Eb2. My lawyer wrote to USCIS this Friday. I don't know when USCIS will correct the mistake so that they can Adjudicate my case being current this month and next month.

I got GC under EB2, I'm planning to start my own business. is there any risk factors if i leave my employer right after getting GC and change the Field of intrest?

I went to US on B1 and came back to india last week, I would like to apply H1 in the current year. Is there any cooling period to apply H1B once come back from US on B1 or Can I start the H1B process immediately.

i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

I have applied I 140 on Jul 6th and got the APPROVAL on Jul 18th from Texas centre :) ... never got a receipt notice... but i know of some of my friends who got a receipt notice before approval ..

I am on H1b and work for a desi consultancy company. My project with a client ended some time ago and due to bad market, I have been so far, unable to get onto another project. Now my employer is asking me to go back to my country for some time as I dont have a project in hand. I am worried that this may result in canceling of my H1b visa. However, employer is trying to assure me that he won't cancel it. I am wondering has anybody (somebody you know) been in this kind of situation. FWIW, I do have an american undergrad degree and have been living here legally and lawfully for past nine years.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.
